§ 90-223. Control of system; rules and regulations.

  • The city shall have the right, power and authority to exercise police powers over the entire sewer and wastewater system, and shall have the right and authority to make rules and regulations governing the operations, extensions and connections with any sewer, sewage works or storm drains within or without the city, and shall have the right and authority to require all persons who connect with such system within or without the city to make connections in accordance with rules and regulations provided, and shall further have the right and authority to deny the use of such system to any person who fails or refuses to comply with such rules and regulations. Nothing contained in this section shall be construed as granting to any person the right to require the city to furnish sewer or wastewater service, and the city shall not be so required to furnish such service if, in its discretion, it is not deemed desirable or feasible.
